Hughes stock was not listed on a national exchange or quoted on the National Association Securities Dealers (NASD) automated quotation system (NASDAQ). Instead, the stock was listed in the “pink sheets.”¹² Individual investors rarely have access to the pink sheets and the information in the pink sheets is not very helpful. The pink sheets contain the names of broker-dealer firms making a market in the stock. Most firms are listed in name only and do not provide bid and ask quotations. Those broker-dealer firms entering quotations are not obligated to execute trades at those prices. In addition, the pink sheets do not reveal when the last trade of the stock occurred, what the stock's trading volume was, or whether the price of any stock sold approximated any quote listed in the pink sheets. 12. University of Washington, 125 Wash. 2d 243 (1994), an animal rights group sought records related to a grant proposal that was submitted but ultimately not funded, including internal, confidential peer-review correspondence formally summarized in so-called “pink sheets.” The Washington Supreme Court held that Washington's deliberative process privilege applied to protect the peer-review correspondence sought because “the pink sheets foster a quintessentially deliberative process.”

The librarian has a schema for forms that includes a slot for the term sheets as an alternate designation, and may even have a slot for the word pink, as in pink slips (which perform the function of informing people that they are fired).
